In accordance with Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the “GDPR”), we would like to provide you with the following information in a transparent manner about the processing of your personal data by us in the recruitment process.

The Controller of your personal data is: Globema sp. z o.o. with its registered headquarters in Warsaw, at 22 Wita Stwosza Street, 02-661 Warsaw, entered in the register of entrepreneurs of the National Court Register by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register under KRS number: 0000024100, with the share capital in the amount of PLN 209,000.00, NIP (tax identification number): 5212743872 (hereinafter referred to as the “Controller”).

Purposes, legal basis and period of processing your personal data – job candidates

Your personal data are processed by the Controller only for recruitment purposes:

for the position for which you apply, for the period necessary to carry out the recruitment process and select a candidate for employment, on the basis of the provisions of the Polish Labour Code – then the legal basis for the processing of your personal data by the Controller is the necessity of such processing to fulfill the legal obligation of the Controller (Article 6 paragraph 1 point (c) of the GDPR) and in the remaining scope on the basis of your consent expressed by a clear affirmative action, consisting in including these data in the application form and sending it to the Controller – then the legal basis for the processing of your personal data by the Controller is your voluntary consent (Article 6 paragraph 1 point (a) of the GDPR);

if you give a separate, voluntary consent to the processing of your personal data for the purposes of future recruitment by including an appropriate statement in your application form, also for the purposes of future recruitment conducted by the Controller, for a period of 6 (six) months – then the legal basis for the processing of your personal data by the Controller is your voluntary consent (Article 6 paragraph 1 letter a) of the GDPR).

For this purpose, you should include the following statements: “I agree to the processing by Globema sp. z o.o. of my personal data contained in my recruitment application for the needs of future recruitments.” in your application form.

Purposes, legal basis and period of processing your personal data – candidates for the conclusion of a civil law contract

Your personal data will be processed by the Controller only for recruitment purposes:

for the position for which you apply, for the period necessary to carry out the recruitment process and select a candidate to cooperate on the basis of a civil law contract – then the legal basis for the processing of your personal data by the Controller is your voluntary consent (Article 6 paragraph 1 point (a) of the GDPR) expressed by a clear affirmative action, consisting in including these data in the application form and sending them to the Controller;

if you give a separate, voluntary consent to the processing of your personal data for the purposes of future recruitment by posting an appropriate statement in your application form, also for the purposes of future recruitment conducted by the Controller, for a period of 6 (six) months – then the legal basis for the processing of your personal data by the Controller is your voluntary consent (Article 6 paragraph 1 point (a) of the GDPR).

For this purpose, you should include the following statement: “I agree to the processing by Globema sp. z o.o. my personal data contained in my recruitment application for the needs of future recruitments.” in your application form.

Information on the requirement or voluntariness of providing your personal data – job candidates

Providing your personal data required by the Controller in accordance with the Polish Labour Code is necessary and required for purposes related to the recruitment process conducted by the Controller and your participation in the recruitment process. Providing other personal data, processed by the Controller on the basis of your consent, is voluntary.

Information on the voluntariness of providing your personal data – candidates for the conclusion of a civil law contract

Providing your personal data required by the Controller in the recruitment advertisement is voluntary, but necessary for purposes related to the recruitment process conducted by the Controller. Providing any additional personal data not required by the Controller in the recruitment advertisement is voluntary.

Categories of recipients of your personal data

The recipients of your personal data may be the following categories of entities (including other Controllers processing personal data on their own):
trusted external entities dealing with recruitment and HR services at the Controller;
trusted external entities providing the Controller with administrative, legal, auditing, as well as IT, hosting, etc.;
couriers and postal operators.

Your rights

A candidate for work has the right to lodge a complaint to the supervisory authority (in Poland: Prezes Urzędu Ochrony Danych Osobowych, 2 Stawki Street, 00-193 Warsaw), if it is considered that the processing of personal data of a candidate for work by the Controller violates the provisions of the GDPR. In addition, the job candidate has the right to:

withdraw consent to the processing of your personal data at any time (if such processing by the Controller takes place on the basis of your consent), which, however, will not affect the lawfulness of the processing that the Controller made on the basis of this consent before its withdrawal;

access to your personal data, including obtaining a copy of the data;

rectify your personal data that is incorrect, incomplete, including by providing an additional statement;

erasure of data (only in situations specified in the GDPR, e.g. when it is not necessary for the purposes for which it was collected or otherwise processed, or was processed unlawfully);

restrict the processing of your personal data (only in situations specified in the GDPR, e.g. when the data subject questions the correctness of personal data – then the limitation of processing takes place automatically, for a period allowing the Controller to check the correctness of the data; the processing is unlawful and the data subject objects to the erasure of the data; or when the Controller no longer needs personal data for the purposes of processing, and at the same time it is needed by this person to assert or defend claims);

portability of your personal data (if the processing of your personal data takes place on the basis of your consent, and if the processing is carried out in an automated manner), including the transfer of this data to another controller, if it is technically possible.
